These Terms of Service ("Terms") govern your use of elevenelevencoaching.com and its content, forms, downloads, and related website features (the "Website"), operated by Eleven Eleven Coaching, LLC ("Eleven Eleven Coaching," "we," "us," or "our"). By accessing or using the Website, you agree to these Terms. If you do not agree, please do not use the Website.

1. Eligibility and Acceptance

The Website is intended for adults. You must be at least 18 years old to submit an inquiry, request services, make a purchase, or enter into an agreement through the Website. If you use the Website on behalf of an organization, you represent that you have authority to act for that organization in connection with the Website interaction.

2. Website Purpose and No Service Relationship

The Website provides general information about Eleven Eleven Coaching, its approach, and its services. Website content is provided for informational and educational purposes. Visiting the Website, submitting an inquiry, exchanging preliminary communications, or scheduling an introductory conversation does not create a coaching, consulting, fiduciary, employment, or other professional relationship.

3. Coaching, Consulting, and Sponsored Services

Coaching, consulting, workshops, assessments, organization-sponsored coaching, or related services are governed by a separate written agreement, proposal, statement of work, booking confirmation, or other service document. That document will describe the applicable scope, fees, scheduling, cancellations, confidentiality, responsibilities, information-sharing boundaries, intellectual property, and other engagement terms.

If these Terms conflict with a signed service agreement, the signed service agreement controls with respect to that engagement. Eleven Eleven Coaching may accept or decline an inquiry or proposed engagement at its discretion. No service relationship begins until the applicable agreement and acceptance process has been completed.

4. Coaching Boundaries

Coaching is a collaborative process intended to support reflection, awareness, decision-making, development, and action. It is not therapy and does not diagnose, treat, or attempt to heal mental health conditions or trauma.

Website content and services are not substitutes for medical, mental health, legal, tax, investment, financial, or other licensed professional advice. You should consult an appropriately qualified professional for advice within those fields.

Eleven Eleven Coaching does not provide emergency or crisis services. If you believe you or another person may be in danger, contact 911 or the appropriate local emergency service. If you are experiencing a mental health crisis in the United States, you may call or text 988 for the Suicide & Crisis Lifeline.

5. Client Responsibility and No Guarantee of Results

You remain responsible for your decisions, actions, use of information, and outcomes. Eleven Eleven Coaching does not guarantee a particular personal, career, leadership, financial, organizational, or business result.

Examples, stories, testimonials, and descriptions of possible outcomes reflect individual experiences or areas the work may support. They are not promises that another person or organization will achieve the same result.

6. Organization-Sponsored Coaching

When an organization sponsors coaching, the participant, sponsor, payer, and Eleven Eleven Coaching may have different roles and interests. The applicable agreements will identify the client or clients, payment responsibility, engagement goals, confidentiality boundaries, sponsor communications, and the information that may be shared.

Unless the applicable agreement states otherwise or disclosure is required by law, private session content, personal reflections, and detailed coaching notes are not shared with the sponsor without the participant's authorization.

7. Fees, Payments, Scheduling, and Cancellations

Fees, payment schedules, refunds, rescheduling terms, cancellations, expiration dates, and related policies for a service will be stated in the applicable service agreement, proposal, invoice, booking page, or checkout terms. Information displayed on the Website may change before an engagement is accepted.

No payment obligation is created solely by viewing the Website or submitting a general inquiry. If a service document and a checkout page contain different terms, contact Eleven Eleven Coaching before paying so the correct terms can be confirmed in writing.

8. Intellectual Property

The Website and its content, including text, graphics, photographs, design elements, downloads, frameworks, methods, worksheets, and other materials, are owned by or licensed to Eleven Eleven Coaching and are protected by intellectual-property laws.

Eleven Eleven Coaching™, The Eleven Eleven Way™, Eleven Eleven Moments™, Eleven Eleven Glimpses™, Eleven Eleven Reflections™, and related names, phrases, and marks are claimed or protected brand assets of Eleven Eleven Coaching, LLC.

You may view and use Website content for your personal, noncommercial use. You may not copy, reproduce, republish, distribute, sell, sublicense, modify, create derivative works from, train an automated system on, or commercially exploit Website content without prior written permission, except as permitted by law.

9. Information and Materials You Submit

You retain ownership of information and materials you submit through the Website. You authorize Eleven Eleven Coaching and its service providers to use that information as reasonably necessary to respond to you, evaluate or administer a requested service, operate the Website, protect the parties, and comply with law, consistent with the Privacy Policy and any applicable signed agreement.

Do not submit information you do not have the right to provide. Eleven Eleven Coaching will not publish your private submission, name, likeness, testimonial, or story for marketing purposes without separate permission.

10. Acceptable Use

You agree not to:

•       Use the Website for unlawful, fraudulent, abusive, harassing, or harmful purposes.

•       Attempt to gain unauthorized access to the Website, related systems, accounts, or another person's information.

•       Interfere with the Website's operation, security, or availability.

•       Introduce malicious code or use scraping, crawling, automated extraction, or similar technology in a manner that damages, overloads, copies, or disrupts the Website.

•       Misrepresent your identity, authority, affiliation, or the source of information you submit.

•       Infringe the intellectual-property, privacy, publicity, confidentiality, or other rights of Eleven Eleven Coaching or another person or organization.

11. Third-Party Links and Services

The Website may include links to or integrations with third-party websites and services. Those services are governed by their own terms and privacy policies. Eleven Eleven Coaching does not control and is not responsible for third-party content, availability, security, products, services, or practices. A link does not necessarily mean that Eleven Eleven Coaching endorses every statement, product, or service offered by that third party.

To the fullest extent permitted by law, Eleven Eleven Coaching disclaims warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, title, and noninfringement.

16. Limitation of Liability

To the fullest extent permitted by law, Eleven Eleven Coaching, LLC and its owners, officers, employees, contractors, and agents will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to your use of, or inability to use, the Website.

To the fullest extent permitted by law, the total liability of Eleven Eleven Coaching for a claim arising solely from use of the Website will not exceed one hundred U.S. dollars. This limitation does not apply where liability cannot lawfully be limited or excluded.

Liability related to a paid coaching, consulting, workshop, assessment, or organization-sponsored engagement is governed by the applicable signed service agreement.

17. Indemnification

To the fullest extent permitted by law, you agree to indemnify and hold harmless Eleven Eleven Coaching, LLC and its owners, officers, employees, contractors, and agents from third-party claims, losses, liabilities, damages, and reasonable costs arising from your unlawful misuse of the Website, your material violation of these Terms, or your infringement of another party's rights.

18. Governing Law and Venue

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Any dispute concerning these Terms or the Website will be brought in a state court located in Contra Costa County, California, or a federal court serving Contra Costa County, unless applicable law requires otherwise or the parties agree in writing to another process.

19. Changes, Suspension, and Termination

We may update these Terms to reflect changes in the Website, services, technology, or legal requirements. Updated Terms will be posted on this page with a revised "Effective date." Continued use of the Website after an update means you accept the revised Terms to the extent permitted by law.

We may suspend, restrict, or terminate access to the Website or a Website feature when reasonably necessary for security, maintenance, legal compliance, prevention of misuse, or business operations. Ending access to the Website does not alter rights or obligations that arose under a separate signed service agreement.

20. Severability and No Waiver

If a provision of these Terms is found unenforceable, the remaining provisions will remain in effect, and the unenforceable provision will be enforced to the maximum extent permitted by law. A failure to enforce a provision is not a waiver of the right to enforce it later.

21. Entire Agreement for Website Use

These Terms and the Privacy Policy form the entire agreement concerning use of the Website. They do not replace a separate signed agreement governing coaching, consulting, workshops, assessments, organization-sponsored services, or other paid services.
